These Terms & Conditions ("Terms") are the agreement between you and SixFiveNine Interactive LLC ("SixFiveNine," "we," "us") governing your use of sixfivenine.io and the SixFiveNine iOS app (together, the "Service"). By creating an account or using the Service, you accept the version of these Terms in force at that time. Questions: support@sixfivenine.io.
These Terms are version-stamped. When they change materially, you will be asked to accept the latest version before starting further real-money activity: new deposits, withdrawals, or cash-match entry. The Privacy Policy and Responsible Gaming page are part of how the Service operates and should be read with these Terms.
1. What the Service is
SixFiveNine offers head-to-head, skill-based strategy competition for cash stakes: matches and tournaments between players, where available. Matches are discrete, opt-in events between players; SixFiveNine hosts the competition and is never your opponent. There are no casino games and no house betting. Match outcomes are determined predominantly by the players' strategy and decisions in play. Matchmaking pairs players by the stake they choose to enter, not by a handicap.
2. Eligibility
- You must be at least 18 years old. Signup rejects under-18 dates of birth, and government-ID identity verification is required before any cash play.
- Cash play is offered only to players physically located in eligible U.S. states. It is not available in Arkansas, Connecticut, Louisiana, Michigan, Montana, South Carolina, or Tennessee, or outside the United States. Your location is verified server-side and cannot be self-reported; using a VPN, proxy, or other anonymizer to misrepresent your location is prohibited and blocks cash access.
- One account per person. Your email address and phone number are unique to your account, and creating or using additional accounts is prohibited.
- Payment instruments you use must be issued in your own name.
- You must not be a person U.S. sanctions prohibit us from dealing with. A sanctions or watchlist screening signal denies cash access pending review of whether the match is genuine.
- SixFiveNine personnel and members of their household may not play cash matches against the public. Designated test accounts used for verification are flagged, excluded from public matchmaking wherever technically possible, and their real-money test play is documented.
3. Your account
You are responsible for your credentials and for activity on your account. Keep your password secret; tell us immediately at support@sixfivenine.io if you suspect unauthorized access. The information you give us must be accurate and kept current; eligibility and identity verification depend on it. Your account, your balance, and your winnings are personal to you and are not transferable to any other person or account; the Service has no gifting, tipping, or player-to-player transfer feature by design.
4. Verification and compliance
Before any cash play, you must complete identity verification (government photo ID, submitted directly to our identity vendor) and pass eligibility screening. Verification and screening run again during your use of the Service, including location checks on cash sessions and risk screening, and every operation that spends or pays out your balance re-checks your compliance standing inside the transaction that moves the funds. (Recovery debits, such as a chargeback reversal, run even on a frozen account; recovery is not gated on good standing.) We may freeze withdrawals, block cash activity, or hold funds while a compliance review or investigation is open; funds are not released mid-investigation. Failing identity verification blocks all cash functionality.
5. Deposits
- Deposits are made by card or tokenized wallet (Apple Pay) through our payment processor; you enter card details with the processor, never with us. No cash, checks, money orders, or cryptocurrency.
- Limits: $5 minimum and $2,000 maximum per transaction, $5,000 maximum per rolling 24 hours across all deposit channels.
- Deposits fund match entry. They are not an investment, earn no interest, and are not insured deposits.
- We never extend credit, and your balance can never go negative.
- Starting a deposit requires completed identity verification and clear compliance standing. If your compliance standing changes in the short window after a hosted payment page has been issued, a charge that still completes is parked on hold and cannot be credited or played.
6. Match play, stakes, and tournaments
- Entering a cash match or tournament debits your stake into escrow for that match. Escrowed stakes go only two places: to that match's participants per the outcome (less the platform fee, which is paid to us) or refunded back to the entrants.
- Your stake is always shown before you enter. Head-to-head cash matches pay the winner the combined stakes less the platform fee in effect. Tournaments state their prize split (for example, winner-takes-all for 4-player and 80%/20% for 8-player) on the web tournament card.
- Entry into a started match is final. If a match is abandoned or cannot complete, stakes are automatically refunded by the platform's reconciliation sweeps. Queued or unaccepted entries can be cancelled and are refunded.
- Tournament matches have forfeiture rules: failing to ready up within the lobby window forfeits your seat to the player who is ready (if neither player readies, the round is cancelled and the bracket is resolved by the operator, with entry disposition per that resolution); prolonged inactivity (repeated auto-resolved turns) resolves the match in your opponent's favor; and a match stalled beyond the platform's recovery window may be resolved based on the recorded match state. Abandoned ordinary head-to-head matches are refunded by the sweeps instead.
- Match results are recorded, and replays are retained for integrity review (see the Privacy Policy for retention).
- These Terms, together with the rules of the game as presented in-product, are the official rules of each competition. Apple Inc. is not a sponsor of, and is not involved in any way with, any contest on the Service.
7. Withdrawals
- Withdrawals are paid only back to the card you deposited with (a referenced credit to the original instrument). There are no third-party payout instruments, by design.
- Current rail limitation: a referenced credit can return at most the unused principal of your settled card deposits. Winnings above that amount stay in your balance, visible and yours, until additional payout rails ship. This is disclosed in the withdrawal screen as well.
- Limits at current settings: $2,000 per request and $5,000 per rolling 24 hours, in up to 4 payout allocations per request; $5 minimum.
- Withdrawals require completed identity verification and clear compliance standing, and may be delayed or frozen during an open review, investigation, or matched refund/chargeback event.
- Processing time depends on the payment processor and your card issuer; a withdrawal is settled when the processor confirms settlement.
- We charge no dormancy or inactivity fees, and we do not impose play-through multipliers on deposits.
8. Virtual coins (discontinued)
The free-play mode and its virtual coins have been discontinued. Coins were virtual items with no monetary value; they were never redeemable for cash, transferable, or withdrawable, conferred no advantage in cash play, and were removed together with the free-play mode. No balance of any monetary value was affected by their removal.
9. Fair play
You must compete in good faith. The following are prohibited:
- Collusion with other players, including intentionally losing a match for any reason (for example, to transfer value to another account);
- Using bots, scripts, AI assistance, or any unauthorized software or hardware to play or assist play;
- Creating or using multiple accounts, or playing on another person's account;
- Exploiting a bug or error in the game rather than reporting it;
- Misrepresenting your location or identity, or interfering with verification;
- Initiating a chargeback on funds you legitimately spent (see §10);
- Harassment, threats, hate, or unlawful or infringing content in match chat or anywhere on the Service;
- Probing, scraping, disrupting, or reverse engineering the Service.
If we determine, after investigation, that you violated these rules, we may void or adjust affected match outcomes, freeze your account while the investigation is open, close your account, and dispose of the balance according to the investigation's outcome, including returning stakes to wronged opponents and recovering amounts you were not entitled to. Match replays and platform records are used as evidence. Funds attributable to clean play are handled through the standard withdrawal rails, subject to completed compliance review.
10. Chargebacks and payment disputes
If a deposit you made is charged back or refunded by your card issuer, your withdrawals are frozen pending review and the disputed deposit still counts toward your 24-hour deposit limit. For a matched, full-amount return, the returned amount is automatically debited from your balance (down to zero, with any shortfall recorded as owed); partial or ambiguous events are handled by our operations team under the same freeze. Chargeback abuse (disputing charges you legitimately authorized) results in account termination, and we may pursue amounts owed. If you believe a charge is wrong, contact support@sixfivenine.io first; genuine errors are corrected on our side.
11. Responsible gaming
Deposit and withdrawal caps, escrowed stakes, no-credit design, and self-exclusion are described on the Responsible Gaming page. You can request exclusion from all cash play at any time; excluding yourself never forfeits your money (returns are subject to completed compliance review and any legal restrictions that apply to the funds).
12. Taxes
You are responsible for taxes on your winnings. Where your winnings in a calendar year reach the applicable IRS reporting threshold, we will require taxpayer information (such as a Form W-9) before paying reportable amounts, and we will file and deliver the applicable information return (such as Form 1099-MISC). We may withhold where the law requires it, including backup withholding if you do not furnish a taxpayer identification number.
13. Account closure and termination
- By you: you can delete your account from Settings at any time. Deletion is deferred while you are seated in a started tournament or an active real-money match, and refused while your account is under a regulatory compliance restriction that requires us to preserve it. Withdraw your balance before deleting. Deletion does not start a payout, and because deletion scrubs your account's identity (including the registered email we would normally use to verify you), recovering a balance afterward requires re-establishing your identity with support@sixfivenine.io by other evidence, which can be slow and, where identity cannot be re-established, may not be possible. Data handling is described in the Privacy Policy.
- By us, for cause: we may suspend or close your account for violation of these Terms, with the balance disposed of according to the investigation's outcome (§9).
- By us, without cause: if we discontinue the Service or close your account without a violation, your balance is returned to you, through the standard rail where it reaches and operator-assisted where it does not, subject to completed compliance review and applicable law.
14. License and intellectual property
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. The Service, including its software, game design, artwork, and match records, belongs to SixFiveNine or its licensors. You may not copy, modify, distribute, sell, decompile, or reverse engineer any part of it except where the law says this restriction cannot apply. Feedback you send us may be used without obligation to you.
You keep ownership of content you write on the Service (such as match chat and profile text), and you give us the license needed to operate it: to relay it to your opponent, store it, review it for integrity and moderation, and include it in published gameplay under the license below. We may remove content that violates §9 and act on the account that posted it.
Gameplay and publicity license. Play on the Service is part of the Service's record, not private content. You grant SixFiveNine a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to record, reproduce, edit, add commentary to, publish, stream, and otherwise use any gameplay on the Service, in whole or in part, in any media now known or later developed. This covers match replays, board states, in-game actions, dice and card outcomes, results, stakes and prize amounts, statistics and rankings, match chat, and the username you played under, for any purpose, including marketing, promotion, highlight reels, tutorials, social media, streaming and video channels such as YouTube, press, and research, without notice, payment, or attribution to you. Your username is public by design, so choose one you are comfortable seeing published. We will not pair your gameplay with the legal name, email address, location, or other information you gave us for account or compliance purposes unless you separately agree to that. This license survives the closure of your account and the deletion of your data; content already published is not recalled when an account is deleted.
15. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-interruption. We do not guarantee that the Service will be error-free or continuously available; scheduled and unscheduled downtime happens, and match recovery is handled by the platform's reconciliation machinery (§6).
16. Limitation of liability
To the fullest extent the law allows: we are not liable for indirect, incidental, special, consequential, or punitive damages; and our total liability for all claims relating to the Service is capped at the greater of $100 or the platform fees you paid us in the twelve months before the claim. This cap does not apply to your account balance itself (your escrowed stakes and withdrawable funds are handled under §§6, 7, and 13), and nothing in these Terms limits liability that the law does not allow to be limited.
17. Indemnification
If your violation of these Terms or misuse of the Service causes a third-party claim against us, you agree to cover the losses and reasonable costs that result, to the extent permitted by law.
18. Disputes with us
Talk to us first. Email support@sixfivenine.io with a description of the dispute and what you are asking for. We will work in good faith to resolve it within 60 days.
Arbitration. If we cannot resolve it informally, you and SixFiveNine agree to resolve the dispute by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with any hearing held in your county of residence or remotely. Either party may instead bring an individual claim in small claims court. You may opt out of arbitration by emailing support@sixfivenine.io within 30 days of first accepting these Terms, stating that you opt out of arbitration.
Individual basis. Disputes are resolved on an individual basis only; neither you nor we will participate in a class, consolidated, or representative action, to the extent this waiver is permitted by law.
Governing law. These Terms are governed by U.S. federal law and the laws of the state where you reside, without regard to conflict-of-laws rules.
19. General
If part of these Terms is found unenforceable, the rest stays in force. These Terms plus the referenced policies are the whole agreement about the Service. We may assign this agreement in a merger, acquisition, or asset sale, with notice to you; you may not assign it. Our not enforcing a provision is not a waiver. Notices to you go to your registered email; notices to us go to support@sixfivenine.io.
